The Main Thing To Do Before Buying An Apartment In Cyberjaya, Malaysia

Before you commit yourself to the purchase of an apartment in Cyberjaya, Malaysia, it would be appropriate to consider certain legal aspect of your purchase. It should be remembered that what is written here is no substitute for seeking legal advise. What is written in this article is only a guide. It is your best interest to seek proper legal advise. I know that there have been complaints about lawyers in the Malaysian press. However, that does not mean that all lawyers are untrustworthy. The majority of them are sincere professionals. So what is the main thing to do before buying an apartment in Cyberjaya?

The very first thing you should do is to conduct a title search. The apartment you are interested in may or may not have a title. If it is a new development, it may not have a title in which case you should obtain from the developer as much detail as you can. If it has a title, then a title search can be conducted.

Basically, there are two types of titles i. e. qualified title and a final title. From the final title will come a strata title (i. e. the ownership of a parcel in a property together with the right of ownership to the common areas). The strata title arises from a parent final title and is the form of title used for each floor or part of a floor in multi-storey apartment development.

The land in Cyberjaya may be transferred under a qualified title at any time after the transfer has been approved by the State Authority of Selangor. But in order for a final title to be issued, the land must have been surveyed (whether for the purposes of the transfer or on some previous occasion) or must have been surveyed under any previous land law and shown on a certified plan prepared on that survey and adopted by the Chief Surveyor for the purpose of the National Land Code.

There are normally two copies of the titles in existence: one is called the issue document of title while the other is called the register document of title. The issue document of title will be in the hands of the owner while the register document will be kept by the Registry of Land Office. If you are shown a title by anyone outside the Registry or Land Office, it will be the issue document of the title. You should remember that the issue document of title may not be as up to date as the register document of title. That is why a title search is necessary before you buy an apartment in Cyberjaya.
