This is a person who assists attorneys who try court cases in family law. The duties of a family law paralegal vary and can include but are not limited to:
- Legal research for family law cases the attorneys are working on
- Investigating the information of a case that is being tried by the family law attorney
- Drafting documents such as letters to send to clients
Basically, they will assist the family law attorney during the representation of clients. When speaking of family law, if a situation occurs in which people needs legal help but do not have the money for an attorney because of low income the paralegal may help out by working in clinics to help these people. They do it without a family law attorney’s help and provide assistance like helping them fill out legal forms. The one thing that a family law paralegal cannot do is give legal advice under the law of the United States.
Cases can include:
- Child custody
- Divorce cases
- Child abuse
- Child endangerment or neglect
- Children who have committed a crime
- Allegations of domestic violence
- Any legal issue between members of the family
Because a family law attorney can handle a wide variety of cases there can be a lot of paperwork and research to do so this is where having a family law paralegal helps out. They can do many of the mundane tasks while the attorney takes care of the legal aspect of the cases.
For example, if the attorney is handling divorce cases and the attorney needs proof that their client’s spouse is not declaring some assets or the attorney is trying to prove there is a legal reason for a prenuptial agreement to be nullified there is going to be a need to gather facts. This will be the duties of a family law paralegal. The paralegal will collect data on these situations, see how the law has been applied in situations that are similar to their case, and research what the law is. If a private investigator is needed a family law paralegal can hire one and direct them on what information they need to gather.
They conduct their legal research using online databases or using law books. The United States court system is a common law system. The courses will follow rulings or precedent that was made by judges earlier in other cases. This information can be essential in helping a client with a similar case by identifying the way the judge has applied the law. All of this information can be gathered by a family law paralegal. In conclusion, a family law paralegal is very important to a family law attorney.
