Understanding Australia’s child support laws

In 1989, the Australian government introduced the Child Support Scheme, which provides a statutory formula that calculates child support payments when parents separate.

Under Australian law, both parents must financially contribute to the upbringing of a child, and the Child Support Scheme was introduced to simplify the process by which the amount each parent contributes is determined.

It was quickly realised that a ‘one size fits all’ formula could not effectively be applied to the vast diversity of Australian families. Over time, therefore, many variations to the standard formula have been developed to accommodate differing family circumstances. This has resulted in rather complex Child Support laws. This can again be complicated by the sensitive nature of paying money to one partner following a divorce.

- How is child support calculated?

At its most basic level, the child support formula considers the income of both parents, the costs of raising children, the number of children in the family, and the amount of time each parent spends with their children. A higher level of Child Support is paid for a teenage child (12 to 18 years)

- Can parents make their own child support arrangements?

Yes. Parents can elect to keep their child support arrangements private, and in this situation no legal intervention is necessary. They can be formal or informal agreements. A formal Child Support Agreement binds partners to the agreed arrangements for either or both parties to provide financial support for a child or children.

- What if I’m not happy with the child support assessment?

It is possible to dispute child support assessments. Your assessment can be reviewed by filling out an application with the Child Support Agency. Your child support agreement can also change when family circumstances, or the circumstance of one or both parties changes.
